As government prosecutors examined the Reflecting Pool to build their case against a three-time Olympic canoeist accused of violently ripping the lining with his bare hands, everything fell apart. They found that damage was consistent all around the pool, even in the middle, \u201cwhere a vandal would not likely attempt to peel the lining.\u201d This evening, the office of U.S. Attorney Jeanine Pirro asked to drop the case against David Hearn, whom she had excoriated after his indictment 29 days ago.<\/p>\n

In a striking 19-page legal document filed late this afternoon, her office undermined everything that President Trump has been saying about the damage to the Reflecting Pool for the past six weeks, including the claim that vandals had used a box cutter to slash the floor of the pool. \u201cThe damage was the result of a botched installation and not vandalism,\u201d Pirro\u2019s office wrote in a motion to dismiss the case.<\/p>\n

Taken as a whole, the court filing acknowledged what has been obvious to anyone who has spent time at the Reflecting Pool in recent weeks and watched the president\u2019s $16.4 million project deteriorate in full view. Almost immediately after its reopening in June, the shallow pool filled with the green algae that the expensive renovation was supposed to have prevented. As park workers rushed to combat the algae, the pool\u2019s sealant began to peel away in chunks. It was surprising to see outlined in legal language how Pirro\u2019s office claims it felt duped. Rather than continue with evidence it acknowledged is not there, it is dropping the case.<\/p>\n

\u201cThe Trump administration\u2019s case against Davey Hearn should have never been brought,\u201d his legal team\u2014Norm Eisen, Mary Dohrmann, and Steve Levin\u2014said in a statement. \u201cIts dismissal today does not erase the abuse of government power in arresting and charging a patriotic American who did nothing wrong. The government\u2019s approach was ready, fire, aim. The administration owes Mr. Hearn an apology.\u201d The White House did not immediately respond to a request for comment. Pirro\u2019s office declined to comment beyond what was in the legal filing.<\/p>\n

The filing largely blamed Department of the Interior officials for supplying information that was used to present evidence to a grand jury and obtain an indictment. Only afterward did prosecutors realize that they had been misled, and that Interior officials \u201cprovided less than fulsome information.\u201d A large amount of data and documents that Pirro\u2019s office later received \u201cstrongly suggest that a rushed and botched installation\u201d is to blame, her office stated.<\/p>\n

\u201cThese documents indicated a rushed and flawed installation process, with repeated failures of the lining during the installation process, and extensive peeling of the lining throughout the Reflecting Pool,\u201d the filing stated. Eddie Wood\u2014an owner of Atlantic Industrial Coatings, which was paid $14.7 million to line the pool\u2014did not immediately respond to messages. Weather delays hampered installation, the filing stated, and rain meant more delays. Internal notes said that the project was \u201csignificantly behind schedule,\u201d which caused further urgency to complete the project before the president\u2019s promised deadline of July 4. A quality-control inspector noted blistering in the finished portions of the liner, requiring further repairs.<\/p>\n

A final inspection was done on June 9, the filing stated, and crews cleaned the site. But only two days later, on June 11, an engineer at the National Park Service was alerted to peeling in the lining. The fact that officials were scrambling and identifying problems eight days before Hearn was arrested was likely going to cause legal problems in the case.<\/p>\n

An open question remains as to how and whether the project, one of the most high-profile priorities for the president, will be completed. The pool has been drained, and the latest legal filing indicated uncertainty over why exactly the lining failed in the first place\u2014and whether problems will emerge again when water is pumped back in.<\/p>\n

I attended Hearn\u2019s court hearings, and they often attracted a crowd of supporters. Some dressed as canoeists; others held signs. At one of his recent hearings, four people wore inflatable-frog costumes. The charges seemed ridiculous to his supporters. But when I recently spoke with Hearn, he told me that the case was hurting his ability to sleep at night. He had once carried the Olympic torch for his country, and he was now worried about being the center of a political firestorm. \u201cIt\u2019s unsettling,\u201d Hearn told me, \u201cto feel like I\u2019m being targeted by my government.\u201d<\/p>\n
